Article 1
In order to protect the legitimate rights and interests of consumers and clarify the responsibilities and obligations of the sellers, Repairers and producers for the repair, replacement and return of some commodities (hereinafter referred to as "Three Guarantees"), these Provisions are formulated in accordance with the product quality law of the people's Republic of China, the law of the people's Republic of China on the protection of consumers' rights and interests and relevant provisions.
Article 2
The term "partial commodities" as mentioned in the present Provisions refers to the products listed in the catalogue of some commodities subject to three guarantees (hereinafter referred to as the catalogue). The catalogue shall be formulated and adjusted jointly by the product quality supervision and Administration Department of the State Council, together with the competent commercial and industrial departments, and shall be promulgated by the product quality supervision and administration department under the State Council.
Article 3
The principle of "Three Guarantees" shall be implemented for the products listed in the catalogue. The contracts concluded between the seller and the producer, the seller and the supplier, the seller and the repairer shall not be exempted from the three guarantees responsibilities and obligations of the provisions.
Article 4
The indexes specified in the catalogue are the most basic requirements for fulfilling the three guarantees. The State encourages sellers and producers to formulate detailed rules for the implementation of three guarantees which are stricter than these provisions. These Provisions shall not exempt the three guarantees liability of products not listed in the catalogue and the responsibilities of sellers and producers that promise to consumers higher than those of products listed in the catalogue.
Article 5
The Seller shall perform the following obligations:
(1) products listed in the catalogue shall not be sold if the implementation of the three guarantees provisions cannot be guaranteed;
(2) to maintain the quality of the products sold;
(3) implement the inspection and acceptance system for incoming goods, and prohibit sales if they do not meet the requirements of legal identification;
(4) when the product is sold, it shall open the box for inspection, conduct correct commissioning, introduce the use and maintenance items, three guarantee methods and repair unit, and provide valid invoice and three guarantee certificate;
(5) properly handle inquiries and complaints from consumers and provide services.
Article 7
Producers shall perform the following obligations:
(1) make clear the three guarantees. If the producer sets up or designates a repair unit, it must provide the consumer with the Three Guarantees certificate, the name list, address and telephone number of the repair unit;
(2) to provide repair technical data and qualified repair accessories to the seller or repairer in charge of repair, be responsible for training and provide repair expenses. Ensure to continue to provide spare parts that meet the technical requirements within five years after the product is discontinued;
(3) properly handle consumers' direct or indirect inquiries and provide services.
Article 8
The validity period of the three guarantees shall be calculated from the date of issuing the invoice, excluding the time occupied by repair and no spare parts to be repaired. Within the validity period of the Three Guarantees, the consumer shall handle the repair, replacement and return of goods with the invoice and the Three Guarantees certificate.
Article 9
In case of performance failure within 7 days after the product is sold, the consumer can choose to return, exchange or repair the product. When returning goods, the Seller shall refund the payment for goods at one time according to the invoice price, and then claim compensation from the producer or supplier according to law or handle the matter according to the purchase and sales contract.
Article 10
If any performance failure occurs within 15 days after the product is sold, the consumer may choose to replace or repair the product. At the time of exchange, the Seller shall exchange products of the same model and specification for consumers free of charge, and then claim compensation from the manufacturer or supplier according to law or handle the purchase and sale contract.
Article 11
Within the validity period of the Three Guarantees, if the products can not be used normally after being repaired twice, the Seller shall be responsible for replacing products of the same model and specification for consumers free of charge or returning the products according to the provisions of Article 13 of the present Provisions on the basis of the repair records and certificates provided by the repairer, and then recover the compensation from the manufacturer or supplier according to law or handle the purchase and sales contract.
Article 12
Within the validity period of the Three Guarantees, if the manufacturer fails to supply spare parts and fails to repair them for more than 90 days from the date of sending them for repair, the repairer shall indicate in the repair status, and the Seller shall exchange products of the same model and specification for consumers free of charge. And then claim compensation from the producer or supplier according to law or handle it according to the purchase and sale contract. If the repair period exceeds 30 days due to its own reasons, the repairer shall exchange products of the same model and specification for consumers free of charge. The cost is borne by the repairer.
Article 13
Within the validity period of the Three Guarantees, if the seller meets the conditions for replacement, if the seller requests to return the goods due to the absence of products of the same model and specification, and the consumer is unwilling to exchange products of other models and specifications, the Seller shall return the goods; if there are products of the same type and specification, and the consumers are unwilling to exchange them and ask for the return, the Seller shall return the goods and charge depreciation fees for the used commodities according to the provisions The depreciation fee shall be calculated from the date of issuing the invoice to the date of return, in which the time occupied for repair and the time to be repaired shall be deducted.
Article 14
At the time of exchange, any defective, unqualified or repaired products shall not be provided to consumers. The validity period of three guarantees after replacement shall be recalculated from the date of replacement. The Seller shall stamp the replacement seal on the back of the invoice and provide a new San Bao certificate or affix the replacement seal on the back of the San Bao certificate.
Article 15
Within the validity period of the Three Guarantees, except that the products can not be used normally due to improper use and storage by consumers, the repairer shall repair the products free of charge (including material cost and labor cost). The repairer shall provide reasonable transportation expenses for large products that should be covered by three guarantees, and then claim compensation from the manufacturer or seller according to law, or handle the matter in accordance with the contract.
Article 16
Within the validity period of the Three Guarantees, sellers, Repairers and producers should be encouraged to provide three guarantees service.
Seventeen
Under one of the following circumstances, three guarantees will not be implemented, but repair can be charged:
(1) the consumer causes damage due to improper use, maintenance and storage;
(2) damage caused by dismantling by a person who is not responsible for three guarantees repair;
(3) without San Bao certificate and valid invoice;
(4) the model of the San Bao certificate is inconsistent with that of the repaired product or altered;
(5) damage caused by force majeure.
Article 18
The cost of repair is provided by the producer. Repair cost refers to the expenses to be paid for normal repair within the validity period of three guarantees.
Article 19
For the products that the seller is responsible for repairing, the producer shall allocate the expenses at one time according to the contract or agreement, and the specific measures shall be determined by both parties. If the seller entrusts or designates a repairer, the form of payment for the repair fee shall be agreed upon in a contract between the seller and the repairer. Special funds for special purposes. If the producer chooses other methods or sets up repair network on his own, the repair cost shall be directly provided by the producer.
Article 20
If a producer, Seller or repairer goes bankrupt, goes bankrupt, merges or splits up, the three guarantees liability shall be implemented in accordance with the relevant laws and regulations of the state.
Article 21
When a consumer has a dispute with a seller, repairer or producer due to the three guarantees of a product, he may apply to the Consumer Association, the quality management association, the user committee and other relevant organizations for mediation, and the relevant organizations shall actively accept the dispute.
Article 22
If the seller, repairer or producer fails to implement the Three Guarantees in accordance with these Provisions, the consumer may appeal to the product quality supervision and administration department or the administrative department for Industry and commerce, and the above-mentioned departments shall order them to handle the matter in accordance with the three guarantees provisions. Consumers can also apply for arbitration in accordance with the law, and they can also directly bring a suit to the people's court.
Article 23
This Regulation shall be interpreted by the product quality supervision and Administration Department of the State Council.
Article 24
These Regulations shall come into force as of the date of promulgation. The national standard fa (1986) No. 177 "Three Guarantees provisions for some domestic household appliances" issued by the former State Economic Commission and other eight ministries and commissions shall be abolished at the same time.
